TRACT 5: W/2 of Section 22-2-34

MANNER OF SALE: This real estate will be offered in 5 individual tracts only.  THERE WILL BE NO COMBINATIONOF ANY TRACTS. Auction procedure and increments of bidding are at the discretion of the auction company.

TERMS: 10% down day of sale, with the balance to be paid on or before November 12, 2026, or upon such terms as may be acceptable to the Seller. Personal and corporate checks are acceptable for the down payment with the final payment to be made in certified funds. All funds will be held by an identified title/escrow company.  Bidding is not contingent upon financing.  Financing, if necessary, needs to be arranged and approved prior to the auction.  Announcements made day of sale take precedence over all printed material and previously made oral statements.

CROPS: Tenants have the right to plant the 2027 wheat on Tracts 1 & 5. Buyers will receive 1/3^rd of the wheat on Tract 5 and no crop on Tract 1. The Buyer will pay tenant 1/3^rd of fertilizer cost on Tract 5 only. Tenant will retain the 2026 corn crop.

FSA INFORMATION: Any future FSA payments will follow the crops and will be paid pursuant to FSA regulations.  

MINERAL RIGHTS: MINERAL RIGHTS ARE BELIEVED TO BE 100% INTACT and all of the Seller’s interest will transfer to the Buyers at closing.

CLOSING: Closing will be on or before November 12, 2026.

POSSESSION: After corn harvest on the acres planted to corn; after the 2027 wheat harvest on any acres planted to wheat this fall; and at closing on the grass and farmstead acres.

TAXES: 2026 taxes will be prorated to the date of closing.

AUCTIONEER’S NOTE: The Focke Family will sell this 880± acres of EXCELLENT CROPLAND at ABSOLUTE PUBLIC AUCTION on Tuesday, October 13, 2026, at 10:30AM CDT at the Columbian Hall in Atwood, Kansas.  

     Tracts 1, 3 & 4 are all cropland. Tract 5 offers cropland, grass and the farmstead. The tenant will have the wheat on TRACT 1 through harvest of 2027 and will not pay rent in the year 2027. Possession of all other tracts is set above under possession.
